Hinesburg Planning Commission

Members present:  Nancy Norris, Will Patten, George Bedard, John Mace, John Buckingham, Jean Isham, Joe Iadanza and Fred  Haulenbeek.

 

Absent:  Carrie Fenn

 

Others present:  Bill Marks(Hinesburg Conservation Committee), Bill Maclay(NRG Architect) and Tom Lyman.

 

The Commission examined the legal review of the proposed changes to the Zoning Bylaw.

 

q       The review noted that Table 1 was missing from the revisions…Jean reviewed it with Roger by phone and it appeared to be okay.  It was added to the table of contents.

 

q       Height limitations- we dropped the fence height restriction and made a note to take up this issue later during a Zoning Bylaw housekeeping review.

 

q       Purpose section- we discussed whether this section should be so lengthy.  Generally, we decided to leave the section alone and ear mark it for a Zoning Bylaw housekeeping procedure later.

 

q       A discussion followed regarding the possible use of a portion of the zone for residential development.  Residential development as a part of a PUD or PRD is permitted in the Industrial I V Zone.

 

q       We reviewed the revised District Boundaries and Limits description provided by our legal consultant and agreed to include his version.

 

q       Purpose section- We deleted the last sentence, “Industrial installations within the zone shall be separated from residential properties, but may share access and common areas with adjacent residential properties”.

 

q       Permitted Uses- approved with 1 small deletion, “in I-V”.

 

q       Purpose section- delete second sentence, “Due to its soil characteristics…”.

 

q       Permitted Uses- add (#7.  Accessory Uses) and move #2 from Conditional Uses and create #8(Accessory uses for the benefit of the employees such as childcare facilities, health clubs or other employee conveniences.

 

q       Permitted Uses- item #1, add “substantial”(before: “utilizes renewable energy…) and “adverse” (before:  “environmental impact).

 

q       Design Standards section- delete the last sentence and substitute, “The DRB may require sidewalks and street trees in the I-V district as a part of site plan or subdivision approval”.

 

q       Parking section-  (#2) Substitute Roger’s language. See his memorandum dated:  August 7, 2002.

 

q       Roger also suggested that the zoning maps be amended.  John Mace has agreed to take on this project.

 

q       Language was added to provide for access to I-V over residential or commercial zones.

 

 

A meeting was scheduled to review all final changes after another legal examination and to vote on the proposal ( August 13, 2002 at 7:30pm.).

 

Other Business

 

Will Patten moved that we accept the letter of agreement (copy attached) between the Town's Zoning Administrator and Vermont Electric Cooperative's Chief Engineer and sign the waiver of the 45-day advance notice provision with respect to VEC's petition for a Certificate of Public Good.    The motion was seconded and approved by the Commission.

 

Jean moved to appoint Jerry Wetzel to represent the Planning Commission at the hearing to be held in St. George on August 14 regarding the upgrading of the communication tower on Mt. Pritchard.  The motion was seconded and approved by the Commission.
