MINUTES OF FEBRUARY 4, 2003

1. MINUTES Clint Emmons made the motion to accept the minutes of January 21, 2003 as corrected. This motion was seconded by Howdy Russell and passed.
2. BROWN – SKETCH PLAN Tim, Kristi, and Craig Brown were first on the agenda with
their engineer, Gunner McCain to present a proposal for sketch plan approval. This subdivision would be on the east side of the Magee Hill Road and 10.10 acres in size and identified as tax map #5-01-08. The remaining Brown farmland is 150 acres and has an existing farm house and mobile home.
Gunner and Tim explained the following issues associated with this project:
Tom McGlenn made the motion to close the public discussion of this sketch plan review and take up this application in deliberative session in order to render a decision. This motion was seconded by Howdy Russell and passed unanimously.
3. EVANSON/GOODRICH – FINAL PLAT PUBLIC HEARING Tom McGlenn opened
the public hearing for final plat review of a proposal by Sam Evanson for an 8-lot subdivision of property owned by Ralph and Robert Goodrich. This property is located on the corner of the Lavigne Hill Road and the Buck Hill Road and identified as tax map #9-01-46.
Sam explained that since receiving preliminary plat approval, the following changes had been made to the plat: the building envelopes on lots 1,2 and 5 have been tightened up; the detention pond has been reconfigured; and the access is moved which is across from the Smiths on the Lagivne Hill Road.
Tom then went through each of the items for Subdivision Review as outlined in the memo to the Board members from the staff:
Path The path on the eastern edge of the property has been turned on the north to better connect with the Pierson trail on High Rock Road. Deed language was submitted that would confer this 20’ wide easement to the Town. There was concern that the area of this easement is wet in some areas. It was also suggested that a better location for the trail might be along the seasonal stream that crosses this property from north to south.
Septic deed easement language Several lots have the septic areas located on them for other lots and these should be shown on the plat with metes and bounds. It was felt that the deed language should ensure that each owner has the right and responsibility to maintain these areas. The deed language will also be revised to include omissions noted in the memo.
Road maintenance The State now requires annual reports on their storm water permit. The ditches and culverts will be included in revised maintenance language.
Lavigne Hill Road Access As there are only two houses using this, there will not be a homeowners association for this private road, but easement language for it.
Detention pond There is about 40’ between this pond and the Buck Hill Road and the vegetation here should provide screening. If this is indeed a “pond” there is a required setback of 75’ from any body of water in the Zoning Bylaw. The power line across this property to the O’Neill property across the street is buried 9’ deep and this should eliminate any problems with it being damaged during other work. There is an easement across this lot #3 to get to this pond to maintain it.
Building envelopes The envelopes for lots 1, 2, & 5 have been tightened up and identified on the plat. It was felt that the envelopes for the remaining lots should also be specifically shown on the plat and not just as being within the setbacks.
Acreage clearing It was felt that having the building envelopes specifically identified on each lot would make is easier to show the no-cut zones. These areas would then be identified in the deeds. It would make it easier to enforce the amount of cutting done in the future.
Tom McGlenn then made the motion to continue this final plat public hearing on an appeal by Sam Evanson for an 8-lot subdivision to the February 18, 2003 DRB meeting at 7:30 p.m. in the Town Hall. This motion was seconded by Ted Bloomhardt and passed.
4. DAVIS – CONDITIONAL USE PERMIT Jeff and Jean Davis were next on the agenda to
request a conditional use permit to replace a camp on Lake Iroquois on Shadow Lane. This property is identified as lot #14-21-10 on the Town tax maps. The existing camp is a pre-existing non-complying structure in that it does not meet the required setbacks. Jeff discussed and answered questions on the following issues in relation to his proposal:
Tom McGlenn made the motion to close the discussion of this conditional use appeal and take up this application in deliberative session in order to render a decision. This motion was seconded by Howdy Russell and passed.
5. DELIBERATIVE SESSION Tom McGlenn then made the motion that the Board go into deliberative session and this motion was seconded by Robert Gauthier and passed. In that session the Board acted on the following items:
